Welcome to BoltonFoods.com. These Terms & Conditions govern your access to and use of the Bolton Foods website and your purchase of products from Bolton Foods.

By using our website or placing an order, you agree to these Terms & Conditions.

1. About Bolton Foods

Bolton Foods sells and delivers premium frozen meat, poultry, seafood and other food products primarily by the box.

References to “Bolton Foods,” “we,” “us,” and “our” in these Terms refer to Bolton Foods.

2. Products

We make reasonable efforts to accurately display and describe our products, including product type, quantity, weight, ingredients and other relevant information.

Because food products naturally vary, the appearance, shape, marbling, colour and exact weight of individual portions may vary slightly from photographs or descriptions shown online.

Unless otherwise stated, products are sold by the box and may contain multiple individually portioned or packaged items.

Product photographs are for illustrative purposes and may not represent the exact individual pieces received.

Any product-specific claims, including claims relating to sourcing, organic certification, production methods, hormones, antibiotics, wild-caught seafood, grass-fed beef or similar characteristics, apply only where specifically stated for that product.

3. Pricing and Taxes

All prices displayed on BoltonFoods.com are in Canadian dollars unless otherwise indicated.

Applicable taxes will be calculated during checkout.

Prices, product availability and promotions may change without notice. A price change will not affect an order already accepted by Bolton Foods unless required to correct an obvious pricing or technical error.

4. Orders

Submitting an order through BoltonFoods.com is an offer to purchase the products in your cart.

Your order is subject to acceptance by Bolton Foods. We may decline or cancel an order where reasonably necessary, including because of:

  • product availability;
  • incorrect pricing or product information;
  • suspected fraud or unauthorized payment;
  • delivery limitations; or
  • technical errors.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

There is currently no minimum order requirement unless otherwise stated during checkout.

5. Payment

Payments may be processed through Shopify and other third-party payment service providers.

Bolton Foods does not generally receive or store complete credit or debit card numbers when payment information is processed directly by a third-party payment provider.

By submitting payment information, you represent that you are authorized to use the selected payment method.

6. Product Availability and Substitutions

Food products are subject to availability.

If an ordered product becomes unavailable, Bolton Foods will normally contact you before making a substitution.

We may:

  • attempt to obtain the originally ordered product;
  • offer you a comparable replacement;
  • allow you to select another product; or
  • refund the unavailable item.

We will not intentionally substitute a materially different product without communicating with you.

7. Delivery

Bolton Foods provides delivery using its own delivery personnel and may use supporting fulfillment technology, including Shipmondo.

Delivery is currently offered free of charge, unless a different charge is clearly disclosed before an order is placed.

Customers are responsible for providing a complete and accurate delivery address, telephone number and any relevant delivery instructions.

We will make reasonable efforts to deliver within the scheduled or communicated delivery period. Delivery times are estimates and may be affected by traffic, weather, product availability, operational conditions and other circumstances outside our reasonable control.

8. Receiving Your Delivery

Our preferred delivery method is to provide the order directly to you or another person at the delivery address.

If you specifically request or authorize Bolton Foods to leave an order unattended at your door or another location, you accept responsibility for retrieving and properly storing the products promptly after delivery.

Because the products are frozen and perishable, unattended orders should not be left outside longer than necessary.

Nothing in this section limits rights or remedies that cannot legally be excluded under applicable consumer protection law.

9. Frozen Products and Food Storage

Many Bolton Foods products are delivered frozen.

Customers are responsible for appropriately storing products after delivery. Products intended to remain frozen should be placed in a suitable freezer as soon as reasonably possible.

Customers are also responsible for following:

  • package preparation instructions;
  • safe thawing practices;
  • appropriate cooking temperatures; and
  • generally accepted food-safety practices.

Do not consume a product if you reasonably believe its packaging has been compromised or that the product has been improperly stored.

10. Changes and Cancellations

Unless a different cancellation policy is provided when you order, customers should request cancellations or order changes at least 24 hours before the scheduled delivery.

Once an order has entered preparation, fulfillment or delivery, Bolton Foods may be unable to cancel or modify it.

To request a change or cancellation, contact Bolton Foods or your Bolton Foods customer representative as soon as possible.

Any rights you have under Ontario consumer protection legislation continue to apply regardless of this cancellation policy.

11. Returns, Problems and Refunds

Because Bolton Foods sells frozen and perishable food products, products generally cannot be returned simply because you change your mind after delivery.

However, we want problems with an order to be addressed.

If you receive a product that is:

  • incorrect;
  • damaged;
  • defective;
  • missing; or
  • in an unacceptable condition when delivered,

contact your Bolton Foods representative or info@boltonfoods.com promptly.

Depending on the circumstances, Bolton Foods may provide an appropriate remedy, which may include a replacement product, refund, credit or another reasonable solution.

Photos of the product or packaging may sometimes be requested to help us investigate the issue.

This policy does not limit any refund, cancellation or other rights available to consumers under applicable law.

12. Allergies and Dietary Requirements

Some Bolton Foods products may contain or come into contact with common allergens, including fish, shellfish, dairy, wheat, soy or other ingredients.

Customers with allergies or dietary restrictions should review the applicable product label and ingredient information before consuming a product.

Contact Bolton Foods if you require additional product information before ordering.

13. Promotions and Discount Codes

Promotions, discounts and promotional codes may be subject to additional conditions.

Unless otherwise stated:

  • promotional offers cannot be redeemed for cash;
  • promotions may have expiry dates;
  • only one promotion may be permitted per order; and
  • Bolton Foods may correct or cancel a promotion issued or applied in error.

14. Website Information

We try to keep BoltonFoods.com accurate and current. However, occasional errors involving pricing, product descriptions, availability, photographs or other website information may occur.

We reserve the right to correct errors and update website content.

15. Intellectual Property

The content of BoltonFoods.com, including its branding, photographs, graphics, written content, design and other materials, is owned by or licensed to Bolton Foods unless otherwise indicated.

You may use the website for personal, non-commercial shopping purposes.

You may not reproduce, commercially distribute, modify or exploit our website content without permission.

16. Website Availability

We do not guarantee that BoltonFoods.com will always be available without interruption.

The website may occasionally be unavailable because of maintenance, technical problems, third-party service interruptions or circumstances beyond our control.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Bolton Foods will not be liable for indirect, incidental or consequential losses arising solely from the use or inability to use our website.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, or limits rights provided to consumers under applicable consumer protection legislation.

18. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

19. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Any dispute will be subject to the jurisdiction of the courts of Ontario, except where applicable consumer legislation provides otherwise.

20. Changes to These Terms

We may update these Terms from time to time.

The version posted on BoltonFoods.com at the time of your order will generally apply to that purchase.

The effective date at the top of this page will indicate when these Terms were most recently updated.
